NOTICE LIABILITY IN CHILD ABUSE

ABSTRACT

Prevent the commission of the offense, if can not prevent,

investigate, find and and punishment the criminals is left to the task of

ensuring the state. But, giving primary task of punishment to the state

does not mean that a person who faced with a criminal incident, release of

liability. People who learned a crime has occurred is obliged to notify the

(criminal) authorities. This obligation is referred to as the obligation to

notify certain crimes in the Turkish Penal Code to all or some of the

people in the society who has a special tasks. Although there is no specific

provision in the Turkish Penal Code to notify the crimes committed

against children, failure to fulfill the notification obligation has been

deemed a matter of aggravating. The article will discuss, in connection

with the abuse of children, the obligation to notify of crimes.

GİRİŞ

Toplumu oluşturan fertler, suçun işlenmesini önlemek,

önleyemediği zaman ise suçluları araştırmak, bulmak ve

cezalandırılmalarını sağlamak görevini devlete bırakmışlardır. Bu itibarla,

toplumda yaşayan herkesin devletten bu asli görevini yerine getirmesini

isteme hakkı vardır. Bu hak, pozitif hukuk düzenlemelerine ihbar ve

şikâyette bulunma hakkı şeklinde yansımaktadır. Suç teşkil eden bir fiilin

işlendiğini öğrenen herkesin yetkili makamlara bildirimde bulunmaları

anayasal bir hak olarak kabul edilmektedir.

Suçluları cezalandırma görevinin devlete bırakılmış olması, bir suç

olayıyla karşılaşan fertleri sorumluluktan kurtarmamaktadır. Suçluların

cezalandırılmasını devletten istemek kişi açısından bir hak olduğu gibi,

herhangi bir suç olgusunun gerçekleştiğini öğrenen kişinin durumu suçu

takibe yetkili makamlara bildirmesi aynı zamanda bir yükümlülük olarak

kabul edilmektedir. Bu itibarla herhangi bir suç olgusunun gerçekleştiğini
