ABSTRACT

In terms of prosecution of some cases, reaching a verdict may

depend on solving a problem which is not directly relevant to the

prosecution. Regarding this particular situation, it is revealing to consider

the first subsection of article 218 of the Criminal Procedure Code which

states: “If the proving of the charged crime depends on solving a problem

that falls under the jurisdiction of courts other than criminal courts, then

the Criminal Court may render its decision rela ted to this problem also by

utilizing the rules of this Code. However, it may decide on suspending the

main hea ring in order to br ing a law suit regarding this problem a t the

competent court, or in order to wait until a pending case is resolved”.

The age of the accused or the victim may be important in terms of a

criminal case. In this regard, second subsection of article 218 of the

Criminal Procedure Code states: “If during the prosecution there is a

problem about the determination of the age of the victim or the accused in

respect to the criminal provisions, then the court shall solve this problem

through using the procedure that is mentioned in the related Act, and

shall render its judgment”

In this paper, article 218 of the Criminal Procedure Code will be

reviewed. In this sence, in parallel with related provision, firstly, it will

consider how a criminal court must act if proving of the charged crime

depends on solving a problem that falls under the jurisdiction of courts

other than criminal courts; secondly, it will endeavor to express as what

must be done if the emerged problem is about the age of the accused or

the victim.

GİRİŞ

Ceza Muhakemesi Kanunu’nun 218. maddesinin birinci fıkrası,

yüklenen suçun ispatının bir başka mahkemece çözülmesi gereken soruna

bağlı olması durumunda ceza mahkemesinin nasıl hareket edeceğine

ilişkindir. Söz konusu maddenin ikinci fıkrasında ayrıca kovuşturma

evresinde mağdur veya sanığın gerçek yaşının tespitinin uygulanacak ceza

hükümleri açısından önem arz etmesi durumunda ceza mahkemesinin

nasıl hareket edeceği hüküm altına alınmıştır. Çalışmamızda Ceza

Muhakemesi Kanunu’nun 218’inci maddesi bütün yönleri ile ele

alınacaktır.

I. MADDE HAKKINDA GENEL BİLGİ

Bir ceza davasında hükmün verilmesi bazen ceza davasının

konusunu teşkil etmeyen bir sorunun çözülmesine bağlı kılınmış olabilir.

Bu duruma ilişkin olarak CMK’nın 218’inci maddesinin birinci fıkrasında

şu hükme yer verilmiştir: “Yüklenen suçun ispatı, ceza mahkemelerinden

başka bir mahkemenin görev alanına giren bir sorunun çözümüne bağlı

ise; ceza mahkemesi bu sorunla ilgili olarak da bu kanun hükümlerine

göre karar verebilir. Ancak bu sorunla ilgili olarak görevli mahkemede

dava açılması veya açılmış davanın sonuçlanması ile ilgili olarak

bekletici sorun kararı verebilir”.

Düzenlemeye göre, bu gibi bir durumda ceza hakiminin önünde iki

seçenek bulunmaktadır: İlk olarak, ceza hakimi ön sorun hakkında kendisi

karar verebilir. Ceza hakimi, sorunu kendisinin çözecek olması halinde,

olayı CMK’da geçerli olan prensiplere göre çözer
